ImageFollowing the defeat suffered by the opponents of former Central Bank of Nigeria Governor; Prof Charles Soludo, within the Peoples Democratic Party at the Court of Appeal, legal battle over the candidate of the party for the forth coming gubernatorial election in Anambra state resumed today at the Supreme Court.

Opponents of Soludo, led by Mr. Valentine Ozoigbo, took the battle to the apex court where they are challenging the judgment of the appellate court. They are asking the apex court to upturn the decision of the appellate court which had held that their suit dwells on political questions which no court can interfere with.

It would be recalled that the appellate court, in a unanimous decision last Tuesday held that the issue of how a candidate of a political party emerged is solely within the exclusive purview of the party as it is an internal affair of the party.

The Soludo challengers are asking the apex court to hold that their case is justiceable and to order the Peoples Democratic Party to conduct fresh primaries according to the party’s constitution for the purpose of selecting a candidate for the Anambra state election.

At today’s proceedings, Justice Dahiru Musdapher leading a 5 man panel of the apex court directed the parties to file in their written addresses and exchange same and fixed hearing of the suit for Tuesday, 16th February, 2010.
